Michael Stuart quoted in Aggregates Manager Magazine

Thursday, February 16, 2012

Michael Stuart was quoted in the Aggregates Manager Magazine article "Judge Rules in Metso Minerals' Favor in Terex Patent Dispute" regarding the Federal District Court for the Eastern District of New York's December 2011 confirmation of a jury's December 2010 verdict which affirmed that Metso Mineral's U.S. patent was infringed by Terex Corporation. Cozen O'Connor's Michael Stuart was lead counsel for Metso Minerals. The final amount of the case is expected to reach $50 million.

Stuart said that the basis of Terex's defense was that "the judge did not interpret the patent correctly" and that a small detail in Terex's conveyer track differentiated it from Metso's model.

Stuart also noted that three other companies are infringing on Metso's patent.

"They have been informed a few years ago they should cease and desist," Stuart says. "As soon as our lawsuit is done, we will be weighing our options."
