High Profile Victory for Pro Player Funding LLC Highlighted in Law360

Alton Hall and Tammy Shea, members of Cozen O'Connor's Commercial Litigation Department, recently secured a summary judgment on behalf of Pro Player Funding LLC in the highly publicized case of Vincent Paul Young, Jr. v. Peoples Financial Services et al. The case involved a loan taken out by Vince Young, quarterback for the University of Texas during their 2005 National Championship season, third overall pick in the 2006 NFL draft, and 2006 NFL Offensive Rookie of the Year.  

The loan was taken out during the NFL lockout in 2011.  A year later, after the loan had been placed in default and Pro Player had begun collection proceedings, Young filed suit against his financial advisor, Peoples Financial Services, and Pro Player alleging fraud, conspiracy, intentional infliction of emotional distress and tortious interference with contract, claiming that he had not signed the loan documents, received the proceeds of the loan, nor was he aware of the loan. 

On November 4, 2013, the 281st District Court of Harris County, Texas, signed a motion granting Pro Player’s motion for summary judgment on the sole remaining claim against it for conspiracy. The case against the financial advisor will proceed to trial on a schedule determined by the Court.  Pro Player has an ongoing collection suit in Texas to collect on its judgment.
