Andy Baer discusses what he expects the Federal Trade Commission (FTC) will address at the International Association of Privacy Professionals Global Privacy Summit in an article in Law360.
Lina Khan, Chair of the FTC, will be making her first public address on privacy issues and experts are anticipating her to provide insight on issues that include creative enforcement approaches, data security expectations, algorithmic bias, and kids’ privacy.
"During the last administration, the FTC took a bit of a step back from enforcement activities and focused more on the deception prong of Section 5 to go after companies that misrepresented things in their privacy policies," Andy points out.
"Now that Chair Khan has come in, we're seeing more of a resurgence in enforcement activity for data security practices and the FTC using the unfairness prong of Section 5 to go after companies that failed to take steps such as patching known vulnerabilities and do proper risk assessments," he adds.
