John R. Ewell was quoted in the article “2nd Circ. Set To Tackle Geico Underpayment Accusations” by Law360. The article discusses whether a New York federal judge properly scrapped a class action accusing Geico and its valuation report provider of underpaying claims for certain vehicles that were deemed total losses, in a case that could impact scores of policyholders.

John Ewell and Joanna Roberto of Gerber Ciano Kelly Brady LLP told Law360 in a joint statement that the New York Department of Financial Services (DFS) regulates the process insurers use for determining fair market value, and carriers are required to follow those procedures and standards, including paying the policyholder the fair market value of the car.
