Roberto of Gerber Ciano Kelly Brady LLP told Law360 in a joint statement that this recent ruling regarding opioid coverage litigation adds to the “clear body of case law” that has found insurers have no defense obligations for pharmacies and pharmaceutical companies facing government opioid suits.

“The court emphasized the brutal reality for CVS that ‘nothing’ can ‘transform’ the governments’ claims into those for bodily injury or property damage covered by their policies,” they said.
