Kenny Cushing and Michael Fernández will serve as faculty for an event hosted by the Litigation Section of the American Bar Association.
This hands-on, innovative three-part program will provide practical skills training and practice tips for taking deposition testimony from financial experts. Using a hypothetical case and mock discovery materials, participants in this program will take, defend, and observe mock depositions of real financial experts from Ankura Consulting Group LLC (Ankura), under the guidance of experienced trial lawyers who will provide participants with feedback, practical tips, and instruction. The program begins with a two-hour webinar, covering the legal concepts and tactical considerations in expert depositions. The webinar will also introduce the case materials and faculty. The case prepared for the program concerns a commercial litigation dispute between contracting parties; the specific issue addressed by Ankura’s financial experts concerns damages. Following the introductory webinar, participants will then have several days to prepare for their mock examinations of Ankura’s financial experts. The mock depositions will take place over Zoom, allowing participants to practice deposition skills in a realistic virtual environment. Throughout each session, participants will have the opportunity to observe other deposition techniques, styles and strategies, and get additional coaching from the faculty.
