Susan Eisenberg will present “Understanding Off-the-Clock Work” at the Practising Law Institute’s Wage & Hour Litigation and Compliance 2025. Susan will address off-the-clock issues faced by employees classified as non-exempt, analyze the compensability of pre- and post-shift work and drive time, discuss when rounding and automatic deductions can violate the FLSA, and explore best practices for at-home work, group chats, and smartphone usage. Additionally, she will examine overtime pre-approval policies and performance metrics related to off-the-clock work and discuss methods for discovering and proving such work in litigation.
