The U.S. Supreme Court issued a unanimous decision in Hana Financial Inc. v. Hana Bank, ruling so-called "trademark tacking" is a factual question that should be dealt with by juries. In an article titled "Lawyers Weigh In On High Court Trademark Tacking Ruling," David Sunshine, a member of Cozen O'Connor's Intellectual Property Department, said "while the Supreme Court's decision in Hana Financial is important in the context of trademark tacking cases, its overall significance is relatively limited since tacking cases are uncommon ... what remains to be seen in what impact, if any, the case will have on whether likelihood of confusion is a question of fact or law on which issue several circuits are currently split."
