At the federal level, marijuana is listed as a Schedule I drug under the Controlled Substances Act, which means it is deemed to have no medical value and a high potential for abuse. The executive branch can reschedule cannabis, but Mariah said this would have a limited effect. Dispensaries may gain some tax advantages, but recreational use would remain illegal. Descheduling or legalizing marijuana would take congressional action.
