Alycen discussed the Arizona Supreme Court and its pending ruling in Gerald Walker III et al. v. Auto-Owners Insurance Co. on a labor depreciation issue and whether a broad evidence rule should be adopted to decide a claim's actual cash value. She stated, “The Arizona appellate court's decision in Melancon v. USAA Casualty Insurance Co. held that an insurance carrier wasn't authorized to reduce coverage for depreciation where the policy did not explicitly say so. The ruling suggests that Arizona's high court will join several other states in saying that labor costs can't be depreciated when determining actual cash value unless the policy specifically allows for it.”
