Ken Fisher was quoted in The Real Deal’s article regarding a favorable decision by the New York Court of Appeals in a legal battle concerning an open lot in Little Italy leased by the City of New York to a gallery that branded it as the Elizabeth Street Garden. In 2019, the New York City Council approved a rezoning and disposition of the lot for the development of a 123-unit, all-affordable apartment building for seniors. While some challenged the project’s effects on the environment, the state’s highest court upheld the city’s determination that there would be no adverse effect, clearing the way for the affordable housing to be built by Pennrose. The project, Haven Green, is also being developed with two nonprofits, RiseBoro Community Partnership and Habitat for Humanity.
Ken, who represented Pennrose in the litigation, said, “The case took longer than it should have, but the courts got to the right result. Apartments for low-income seniors are needed now more than ever, and the sooner they get built, the better.”
