Federal Contract Issues May Lead to W&H Suits, Lawyer Says

Eric Leonard, co-chair of the firm’s Government Contracts practice, was interviewed in a Law360 article discussing what the rescission of Executive Order 14026 means for contractors and their wage obligations. Eric covers the most crucial thing for federal contractors to do right now, how contractors should deal with the confusion on the federal contract minimum wage rule, and the Trump Administration’s efforts to vacate the Fifth Circuit opinion upholding the federal contractor minimum wage. 

He also discusses whether we will see a rise in wage and hour litigation or complaints to the DOL. “We're in a situation where invoices are not being paid and massive amounts of cash flow are being affected by whether it's a funding freeze or a stop work order or something of that nature. It's going to be challenging, particularly for smaller contractors that don't have a financial safety net that maybe some other larger contractors have if invoices aren't getting paid,” said Eric. “So I do expect to see an uptick in complaints raised as a result of either failure to pay wages in a timely fashion or an underpayment of wages for a particular time period.”
