Protecting Condominiums From Undesirable Purchasers [New York Law Journal]

Leni Morrison Cummins, a member of Cozen O’Connor’s Real Estate practice, answers a difficult question: How can condominiums protect themselves from purchasers who cannot provide sufficiently detailed financials or from occupants who may be undesirable? This is a cause of concern for condominium boards because, since they are governed by real property law, they do not have the right to simply reject purchasers (unlike cooperative boards that do have the right to reject). Legal tactics do exist that condominium boards can use to ward off undesirable buyers.
