Michael Fernández contributed an article to the Kluwer Arbitration Blog discussing the challenges created by the personal jurisdiction requirements under U.S. law in the enforcement of foreign arbitral awards. Michael covers the U.S. Supreme Court’s opinion in Daimler AG v. Bauman, the hurdles posed by implementing the Daimler standard, and proposes a solution to modify arbitration clauses to bypass these hurdles in the future.
