Kenneth Levine, co-chair of Cozen O’Connor’s Insurance Corporate & Regulatory Practice, authored an article on the contractual obligation to perform during a global pandemic. Ken examines “the nature and applicability of the companion doctrines of impossibility and temporary impossibility in contract law to discharge or suspend, respectively, a party’s performance without breach, to maintain as close as possible the balance of risk that the parties envisioned when they struck their agreement.” It is the first law journal article written specifically on the subject of temporary contractual impossibility since 1961.
