Co-op and Condo Boards Need to Prepare for a Possible Second Wave

Leni Cummins discusses efforts condo and coop boards can take now to protect and prepare themselves for a possible second wave of the virus in Habitat magazine. With New York slowly lifting restrictions resulting from the coronavirus pandemic and other states seeing a resurgence in new COVID-19 cases as they reopen, Leni suggests condo and coop boards reevaluate governing documents and adopt rules and amendments to prepare for a potential second wave of the coronavirus as well as future pandemics.

“Most standard forms of proprietary leases and bylaws do not adequately address the novel issues and situations presented by the governor’s shelter-in-place orders and other governmental agency and administrative quarantine protocols,” Leni said. “Further, many board forms and agreements, such as alteration agreements and construction contracts, should be updated before work proceeds.”
