CBP Implementing ESTA for Visa Waiver Program Travelers at Land Ports of Entry

April 5, 2022

On April 1, 2022, U.S. Customs and Border Protection (CBP) issued the interim final rule implementing the Electronic System for Travel Authorization (ESTA) requirements for noncitizens who intend to enter the United States under the Visa Waiver Program at land ports of entry. These travelers will no longer provide biographic information to CBP on a paper form I-94 Admission Record. Instead, they will provide this information electronically through ESTA prior to application for admission to the United States. The rule is effective 5/2/22, and comments will be accepted through 5/2/22. (87 FR 18967, 4/1/22).
